How to keep notes that hold up

Write notes as soon as you can. Keep the original account rather than replacing it later; the venue decides what weight it gets.

          1. Write it down straight away, on paper or in the box on a step.
          2. Put the date, time and place at the top, and who you spoke to.
          3. Use their words where you can; separate what you saw from what you were told.
          4. Sign or initial a paper note, photograph it and add the photo.
          5. Never edit an old note. Add a new dated entry when something changes. A device save time is not independent time evidence or proof of event order.

Missing time records can let workers estimate hours

Workers sought pay for work their employer had not logged well. The court said a fair estimate can shift the task of proof to the employer. The employer must then give precise proof or show the estimate is wrong.

Check work diaries against leave and other records

A worker sought more overtime pay using a home diary. Checks found leave days counted as work and other gaps. The court kept the lower hours figure supported by the employer.

Partial logs can support a fair hours estimate

A worker sought pay for time the employer had not logged. Partial training logs and the worker's account supported a fair estimate. The court ruled for the worker because the employer gave no proof against it.

False payroll records can bring a work ban

Workers' accounts did not match a contractor's time cards and pay records. The court kept the finding that records hid unpaid overtime. It also kept the contractor barred from covered work.

The opinion does not describe employees using their own dated work logs.

          Federal courts, FLSA overtime claims

The U.S. Supreme Court wage-record decision (1946) describes a worker’s reasonable inference from sufficient evidence when the employer’s records are inadequate.

Accepts worker evidence of any kind that is credible; does not name digital or timestamped records. A dated log helps the inference but weight is for the court.

          Proves / Doesn’t prove

          Proves

A completed time receipt shows that the exact selected file existed by the independently witnessed time. You can check whether a later copy has the same bytes. It does not establish creation time, authorship, identity, event order, location or the truth of the contents.

          Doesn’t prove

It does not prove you worked those hours, who made the entry, where you were, or that a court, agency or employer will accept it.

This cannot establish hours worked, identity, location, wages owed or acceptance by an employer or agency.

These are the bounds of a completed proof. The local tester does not establish any time. The chosen court, scheme or regulator decides what to accept.

Can my own record of hours be used if my employer kept none?

In US federal wage cases, yes in principle: if the employer's records are inadequate, a worker can show hours by a just and reasonable inference, and the employer must then answer with precise records or evidence against it. The court decides how much weight your record gets.

How long must my employer keep my time records?

Under US federal rules, payroll records for at least 3 years and time cards or similar wage-computation records for at least 2 years. State rules can differ.

Why did a worker's diary not win in court?

In one Alaska case the worker's diary was compared with other reports and showed leave days counted as work and other mismatches, so the court used the employer's lower figure. A record only helps if it is consistent and honest.

What should a good daily hours log include?

Date, start and stop times, breaks, tasks or location in plain words, and who assigned the work, written the same day. The DOL lists daily and weekly hours among the data employers must hold, which is a useful checklist for your own log.

Is a partial or estimated log still worth keeping?

It can help. In one federal trial a worker's admitted estimate plus some training logs was accepted because the employer had no proof against it. Results depend on the court.
