Keep the completed copy and its source records. A time receipt dates those exact bytes; it does not establish that an entry is true or accepted. Save a new copy when a condition set is complete.

How to keep notes that hold up

Write notes as soon as you can. Keep the original account rather than replacing it later; the venue decides what weight it gets.

            1. Write it down straight away, on paper or in the box on a step.
            2. Put the date, time and place at the top, and who you spoke to.
            3. Use their words where you can; separate what you saw from what you were told.
            4. Sign or initial a paper note, photograph it and add the photo.
            5. Never edit an old note. Add a new dated entry when something changes. A device save time is not independent time evidence or proof of event order.

            Scope of the cited rule.

In Washington State, RCW 59.18.260 requires the covered move-in condition checklist to be signed and dated by landlord and tenant when collecting a security deposit. This is Washington guidance, not a universal checklist rule.

Keep repair requests with photos and checklists

A tenant disputed damage claims and relied on a move in list and a texted flood photo. The manager did not recall the text, and there was no written repair request. The appeal court kept the decision against the tenant.

Texas appeal decision; the record included evidence from both sides.

Keep rent receipts beside property photos

A tenant disputed rent owed and items in the landlord's photos. No cash rent receipts were shown, and the lease said the home started in excellent condition. The appeal court kept the tenant's loss.

Return the signed move in checklist

Tenants said their landlord signed the move in checklist but never sent them a copy. The appeal court found that broke the rule and overturned a ruling that paid them nothing. It also called for a new look at repair costs under the right test.

Keep the photos you sent when faults appeared

A tenant sent photos of damp and defects, while the landlord said the scenes had been made to look worse. The jury largely sided with the tenant. The appeal court reduced one payment but kept the finding that the landlord wrongly held the deposit on purpose.

Appeal decision with a partial reduction in damages; the deposit finding remained in place.

            Residential Landlord-Tenant Act, RCW 59.18.260

A written move-in checklist describing condition and existing damage must be signed and dated by landlord and tenant and a copy given to the tenant; if none is given, the landlord is liable for the deposit and fees can be awarded.

The law wants a signed, dated checklist; a time receipt on your own files does not replace it but can date your own photos alongside it.

            Proves / Doesn’t prove

            Proves

A completed time receipt shows that the exact selected file existed by the independently witnessed time. You can check whether a later copy has the same bytes. It does not establish creation time, authorship, identity, event order, location or the truth of the contents.

            Doesn’t prove

It does not prove who took a photo, where or when the scene was actually photographed, that it shows the real condition of the unit, that the landlord received it, or who is entitled to the deposit.

This cannot establish truthful photos, notice to the landlord, entitlement to the deposit or acceptance of a claim.

These are the bounds of a completed proof. The local tester does not establish any time. The chosen court, scheme or regulator decides what to accept.

            Questions, answered plainly.

Your file stays on your device. During normal receipt creation, your device sends a randomized code made from its fingerprint, plus encrypted recovery data. It doesn't send the plain fingerprint or the random value that opens the code. Keep the original file and the complete receipt for checking. Privacy Policy.

What evidence do I need to get my security deposit back?

Proof you paid the deposit, the lease, move-in condition (a signed checklist and dated photos), move-out photos, and your messages with the landlord, plus proof of your forwarding address. Rules differ by state or country.

Who has to prove the damage, the tenant or the landlord?

In UK deposit schemes the deposit stays with the tenant until the landlord provides evidence for a deduction. In US states it varies, but landlords generally need to document what they charge for.

            Context for this answer
Should my photos have a date and time on them?

Yes. A UK deposit scheme advises a visible date and time stamp and says blurry or undated images are weak evidence. A time receipt adds a separate date for the file itself.

            Context for this answer
Do text messages and emails count as evidence?

Generally yes. One UK deposit scheme calls texts, WhatsApp chats and emails valid written communication, and says phone calls with no written follow-up are very hard to prove.

What if the landlord never gave me a move-in checklist?
