Family loan recordkeeping checklist — Keep the agreed terms before money becomes a dispute. Use the keeping checklist for the agreed terms and signed copies. It is not a loan agreement or promissory note.

Your photos and files stay on your device, so keep them.

Your free family loan keeping checklist.

Not a loan agreement or promissory note. Use an appropriate local template or lawyer for the agreement; this only tracks the terms and copies. A worksheet, not an official form; use your regulator's / carrier's / insurer's own form where one is required.

  • Amount recorded in the agreement
  • Repayment schedule recorded
  • Interest, if any, recorded
  • Signed-copy references
  • Who holds each copy

Check your regulator's own form. The printable version lists the source behind every field. CSV versions have an instruction row above the headings.

Then date your filled-in copy.

Keep the completed copy and its source records. A time receipt dates those exact bytes; it does not establish that an entry is true or accepted. Save a new copy when signed records change.

Your record, one step at a time.

How to keep notes that hold up

Write notes as soon as you can. Keep the original account rather than replacing it later; the venue decides what weight it gets.

          1. Write it down straight away, on paper or in the box on a step.
          2. Put the date, time and place at the top, and who you spoke to.
          3. Use their words where you can; separate what you saw from what you were told.
          4. Sign or initial a paper note, photograph it and add the photo.
          5. Never edit an old note. Add a new dated entry when something changes. A device save time is not independent time evidence or proof of event order.

A loan memo can help show repayment intent

A relative lent money with no signed note, but the cheque said loan and interest was paid for years. The court found a promise to repay and used a fair time for repayment. The appeal court kept the lender's win.

Treat each family payment on its own facts

Parents gave a couple several payments, but only one had a signed loan note and security. The appeal court treated the earlier payments as gifts and the note's claim as too old. It set aside the ruling that the husband owed the parents.

A family note may not prove real debt

A husband gave his wife money in return for a signed note backed by shares. The tax court found no real intent to seek repayment in the family plan. It refused the tax break for the unpaid debt.

FRE 902(13) and 902(14): self-authentication of certified electronic records and data copied from a device or file, authenticated by a process of digital identification

Rule text plus 2017 committee note say hash values are the usual digital identification method and matching hashes indicate identical copies, supported by a qualified person's certification with notice. Applies to authenticating a file, not to proving who made it or what it means. State courts have their own rules.

          Proves / Doesn’t prove

          Proves

A completed time receipt shows that the exact selected file existed by the independently witnessed time. You can check whether a later copy has the same bytes. It does not establish creation time, authorship, identity, event order, location or the truth of the contents.

          Doesn’t prove

It does not prove who signed or sent the money, that the money was a loan rather than a gift, that anyone intended repayment, or how a court or tax authority would rule.

This cannot establish signatures, money transferred, an obligation to repay or a court or tax outcome.

These are the bounds of a completed proof. The local tester does not establish any time. The chosen court, scheme or regulator decides what to accept.

          Questions, answered plainly.

Your file stays on your device. During normal receipt creation, your device sends a randomized code made from its fingerprint, plus encrypted recovery data. Does a family loan need to be in writing?

Often a loan can exist without a written note, but it is much harder to prove. Courts look at intent to repay, and some states require corroboration for larger oral agreements. A signed agreement plus the transfer record is the safest paper trail.

How do I prove money was a loan and not a gift?

Evidence of intent to repay: a signed note or agreement, a loan label on the transfer, repayment terms, actual repayments or interest, and no pattern of the lender treating the money as a gift. A note alone is not always enough.

It leaves a date in your mail account, but it is controlled by a mail provider and easy to dispute. An independent RFC 3161 timestamp authority dating the fingerprint is a stronger, separate record of the date.

Do I need to worry about gift tax on a family loan?

The IRS defines a gift as a transfer without full consideration back; a real loan is not a gift, but a transfer treated as a gift can count toward the annual exclusion ($19,000 per recipient for 2026). Ask a tax professional about interest and your situation.

          Should I also record repayments?

Yes. Each repayment is evidence the money was a loan, as in the Indiana case where years of interest payments supported the loan finding. Add repayment records as separate time receipts.
